Please carefully review the following Terms and Conditions, as they will be applicable to your booking with Tribal Trips. By using our site and services, you confirm that you:
Have legal capacity to enter into binding contracts (i.e. you are at least 18 years of age and any individual you are booking for also meets this criteria). Will only use our site for the sole purpose of accessing and utilizing our services.
These terms govern the relationship between ‘you’ (referring to the individual or group) and ‘we’, ‘us’, ‘our’, or ‘the company’ (referring to Tribal Trips Ltd, a company registered in England), which will provide the ‘service’, ‘tour’, or ‘tours’.
The website, located at www.tribaltrips.com (referred to as ‘The Site’), is owned and operated by Tribal Trips Ltd. These Terms and Conditions will apply to your booking and include details such as the cancellation policy and specific limitations of liability. It is important to note that these Terms and Conditions impact your rights and designate the governing law and forum for resolving any disputes.
If you have any questions, please do not hesitate to contact us before utilizing our website, booking a tour, or participating in a tour.
Booking a Tour
When booking a tour through our website or a travel agent, you confirm that you have the authority to accept and agree to the terms of these booking conditions on behalf of your party. If we accept your booking, we will send a confirmation email containing relevant details for the tour, a payment invoice, and a copy of these terms and conditions.
Once the confirmation email is sent, a confirmation number will be assigned, and a contract will be established. The terms and conditions included in this contract are governed by English Law, and the jurisdiction of the English Courts. Once the contract is in place, you or your party cannot cancel the booking except in accordance with our cancellation policy and terms and conditions.
It is your responsibility to review the booking details provided in the confirmation email. If you notice any errors or discrepancies, please inform us in writing within 48 hours of receiving the confirmation email.
We reserve the right to accept or reject any booking for a tour, at our discretion and for any reason.
Payment
The fees for your selected tour will be determined during the booking process and specified in the confirmation email. Payment of fees should be made to us through the designated payment method on our site and in accordance with the invoice payment terms. The full fee must be paid prior to the start of your tour, and failure to pay the full fee may result in cancellation of your participation in the tour in accordance with these terms.
We reserve the right to modify our fees at our discretion, and it is your responsibility to verify the current fees before submitting your booking through our site. Please note that once your booking is complete, the fee for your tour will not change.
Cancellation
In the event that you cancel your tour after making partial or full payment of the fees:
(a) Cancelling more than 60 days before the tour start date allows you to change or move the tour at no additional cost. If you choose to no longer travel with us, a cancellation fee of 25% of the tour value will apply. We will refund the remaining balance of any fees paid by you, if applicable.
(b) Cancelling within 60 days of the tour start date allows you to change or move the tour subject to any applicable administrative fees. If you no longer wish to travel with us, a cancellation fee of 100% of the tour value will apply.
If you cancel on the tour start date or anytime thereafter, or if you do not show up for the tour, you are obligated to pay the full fee, and no refunds will be issued.
Transfer of Service
If you are unable to take part in a tour, kindly inform us. We may, at our discretion, permit you to transfer the tour or any portion of the fee paid by you to another person in certain situations. However, please note that we are not obliged to do so, and this permission will be granted solely at our discretion.
Deposits
Any deposits collected for any tour on any start date are non-refundable.
In case you book a trip using an initial deposit of £99 and do not complete the payment 60 days prior to the departure, we hold the right to cancel your reservation.
Your spot on the trip will be relinquished to accommodate other reservations. If you cancel the booking, we will retain the initial deposit in our system, which can be utilized by you for future travel with us.
Force Majeure
A force majeure event refers to an event or circumstance that is beyond our control, which includes but is not limited to war, civil unrest, pandemics, terrorist activities or the threat of terrorist activities, actions taken by governments or local authorities, strikes, labor disputes, demonstrations, natural disasters, or any similar event that is beyond our control.
In the event that we must suspend or significantly modify your Tour due to a force majeure event, we will provide you with an alternative date or Tour, or a full credit that can be applied to any future travel with us. Please note that we will not be held responsible for refunding your payment or providing compensation in such cases.
Changes To The Itinerary
Unexpected circumstances or events may require changes to the Tour itinerary. If we are unable to provide a particular inclusion in the itinerary due to events or circumstances beyond our control, we will make every effort to substitute it with an inclusion of equal or greater value.
Limitation of Liability
Third-Party Services: We may engage third-party service providers to deliver Tours to you. We make no guarantee or representation regarding the quality or availability of their services, and to the fullest extent permitted by law, we disclaim any responsibility or liability for their performance or failure to perform.
No Warranties: You acknowledge that information and materials on our Site may contain errors or omissions and may be unavailable at times. We provide all such information and materials to you on an “as-is” basis and without any express or implied warranties or conditions. We expressly disclaim any warranties, guarantees, representations or conditions of any kind.
Exclusions: To the fullest extent permitted by law, we exclude all liability for:
- Your use of the Site;
- Your acts or omissions, including your participation in any Tour;
- Acts or omissions of any third party, including but not limited to government agencies, hotels, tour operators, or airlines;
- Events or circumstances beyond our reasonable control;
- Any information or documentation you provide;
- Property loss or damage, including baggage, personal injury, loss or death; and
- Consequential loss.
Limitation of Liability: To the fullest extent permitted by law, our total liability for any claim arising out of or in connection with these Terms, including under contract, tort (including negligence), equity, statute or otherwise, will be limited to either, at our sole discretion, resupplying the relevant Tour or paying an amount not exceeding the Fees paid by you to us for the Tour.
Indemnification: You agree to indemnify us against all Claims resulting from your breach of these Terms, including legal costs and expenses on a full indemnity basis.
The provisions in this clause (‘Limitation of Liability and Disclaimers’) will remain in effect even after termination of these Terms.
Passports & Visas
You are solely responsible for meeting the legal obligation of having a valid passport that covers the duration of your planned stay plus an additional six months, as well as obtaining a valid visa for the entirety of your intended activities, including any potential extensions. We cannot be held accountable if your entry is denied due to issues with these documents.
Photos & Videos
During the tour, other group members, your group leader, or our suppliers may take photos or videos of you, and you may provide us with media that you have personally taken. By participating in the tour, you acknowledge and agree that we have the right to use these photos and videos on our website, social media, and printed materials, which may include details such as your name, location, and tour dates.
However, if you do not wish for any of these images to be used, you may inform us immediately upon seeing them, and we will remove them and refrain from using them for any future marketing purposes.
Code Of Conduct
While participating in a Tour, you are required to conduct yourself in a proper manner and cooperate with us, including following our instructions and complying with these Terms. Your behavior must be appropriate, decent, lawful, non-aggressive, and non-bullying at all times. If we deem your conduct inappropriate, we may terminate these Terms and ask you to leave the Tour, and you will not be entitled to a refund.
Please note that we are unable to control the behavior of you or any third party during the Tour. Therefore, we will not be responsible or liable for any conduct of you or any third party to the maximum extent permitted by law.
Data Protection & Privacy Policy
To process your tour booking, we collect information from you, such as contact information, personal details including your date of birth and preferences, to ensure your eligibility. We are responsible for safeguarding the information you provide and follow data protection principles. Failure to provide certain personal information may prevent us from providing our tours to you.
We may share your information with third-party suppliers and tour operators who assist in delivering our services and itineraries, such as booking travel arrangements with airlines and other transport companies. If required by law, we may also disclose your information to public authorities such as customs or immigration.
We may retain your personal information to communicate with you about future tours and may use it for marketing purposes unless you opt-out after your trip has finished. We understand that some of your data may be sensitive, such as religion or health details. Therefore, if you wish to view the personal information we hold about you, you may request to obtain it, and we can explain why we keep it and which third-party suppliers may require what information and why.
Please notify us if there are any changes to your personal details or if any information provided is incorrect. By providing personal information, you permit us to collect, hold, use, and disclose your personal information according to the above terms. If you object to any of the above, please inform us in writing.
